Welcome to our two cozy vacation apartments in Braunlage! Our modern accommodations offer enough space for up to 6 people and are the ideal place for a relaxing family vacation, a romantic getaway for couples or an adventure vacation with friends. In our apartments, dogs are also very welcome!

One of the vacation apartments has its own wellness area with sauna and whirlpool, where you can relax wonderfully after a long day in the nature of the Harz mountains. The other apartment offers you a cozy atmosphere and a magnificent view of the surrounding area.

Both our apartments are equipped with modern facilities and offer everything you need for an unforgettable stay. From a fully equipped kitchen to cozy beds and a large living area with flat screen TV and fireplace - with us no wishes remain unfulfilled.

The location of our vacation apartments is ideal for hikers and skiers, as the most beautiful hiking and skiing areas of the Harz Mountains are in the immediate vicinity. For families with children there are numerous recreational opportunities in the area, such as the adventure mountain Wurmberg or the swimming pool Braunlage. General Terms and Conditions (GTC)

1 Booking procedure

1.1 By booking the vacation apartment, electronically (by e-mail, fax, portals, Löwenbaude homepage), by post or by telephone, the guest of the booking offers the accommodation company (Löwenbaude team) the binding conclusion of an informal accommodation contract. As soon as the guest receives a booking confirmation from the Löwenbaude team or the respective booking portal after the booking with exact details of the duration and price of the accommodation, the conclusion is binding and the vacation apartment is considered occupied for this period. The vacation rental is based on the statutory provisions and these GTC.

1.2 The conclusion of the contract obligates both contracting parties to fulfillment, regardless of the duration of the contract.

2 Number of persons and purpose of use

2.1 When booking, the guest must indicate all persons who will be using the vacation apartment (obligation to register). In the event that unauthorized accommodation of foreign overnight guests is discovered, this will be charged subsequently at twice the overnight rate.

2.2 The guest has the possibility to register overnight guests with the Löwenbaude team electronically (by e-mail, fax), by post or by telephone up to 10 days before the transfer (obligation to register). A consideration of the vacation apartment about the maximum number of persons is not allowed.

2.3 The vacation apartment is made available to the guest for the duration of the contract exclusively for use for residence purposes. A commercial use requires prior approval. In the event that an unauthorized commercial use is determined, this will be subsequently charged at twice the overnight rate.

3 Accommodation price and terms of payment

3.1 The booking price includes the usual additional costs, especially electricity, water/sewage, heating, firewood if necessary, sauna and whirlpool use if necessary, W-LAN as well as the final cleaning, bed linen and towels. The spa fees p.p./night as well as costs for bringing pets plus the additional cleaning are added to the accommodation price.

3.2 No later than 14 days after receipt of the booking confirmation, the guest must pay a deposit of 50 percent of the total cost. The remaining amount is due 14 days before arrival at the latest. If the guest pays by credit card, the remaining amount will be debited automatically. In case of other payment methods, the guest is responsible for timely payment. The date of receipt on the account of the Löwenbaude team and not the date of the instruction is decisive for compliance with the payment deadlines.

3.3 In the event of a booking via a customary internet portal, the individual payment terms of the respective booking portal shall apply and, if applicable, the payment may be processed in part or in full via the respective booking portal.

3.4 A rental deposit shall not be charged in favor of the guest if not expressly included in the booking confirmation. However, this does not release the guest from being liable for any damage caused by him.

3.5 The Löwenbaude team may, in exceptional cases, also subsequently, determine a rental security in an appropriate amount and demand it from the guest if there are special reasons in the person of the guest, the registered persons, the number of persons, the booking duration or the purpose of use.

3.6 In the cases according to 3.5, the rental deposit is due with the final payment 14 days before arrival and is to be returned to the guest by Team-Löwenbaude no later than 21 days after departure, provided that the guest has used the vacation apartment in accordance with the contract, left it in orderly condition and free of damage / defects.

3.7 If the guest does not pay the collected rental security, the Löwenbaude team reserves the right to cancel the booking.

4 Arrival and departure / access via numerical code

4.1 The vacation apartment is available to the guest from 15:00 on the day of arrival, unless otherwise agreed.

4.2 The access to the vacation apartments is keyless by means of number code tablets, which are placed next to the doors. The door locks open after entering a four-digit numerical code. The guest will receive the number code for his individual access from the Löwenbaude team by e-mail at least three days before arrival.

4.3 On the day of departure, the guest must leave the vacation apartment broom-clean by 10:00 a.m. at the latest and return it to the Löwenbaude team.

4.4 Furniture and furnishings are to be returned to their place as found on arrival. Used dishes, cutlery, pots, pans, kitchen utensils and similar items are to be put away cleaned in drawers/cabinets. The dishwasher is to be emptied.

4.5 Before departure, the guest must dispose of his residual/organic waste in the designated trash cans at the side of the vacation home, recyclable materials/paper/bottles in the public recycling containers and also his deposit empties himself.

4.6 If the vacation home is not in a broom-clean condition after departure, but requires a considerable additional cleaning effort, this will be charged to the guest subsequently.

5 Cancellation by the guest

5.1 Cancellation of the accommodation contract by the guest must be made in writing (mail, e-mail or fax), in short-term cases also by telephone or via the respective booking portal. The date of receipt of the notice of cancellation by the Löwenbaude team shall be decisive.

5.2 The cancellation fees for bookings made directly with the Löwenbaude team amount to 20 percent of the agreed accommodation price in the event of cancellation up to 21 days before the start of the stay, and 50 percent of the agreed accommodation price in the event of cancellation at short notice from 20 days before the start of the stay until the last day before the start of the stay.

5.3 In the event of booking and cancellation via a customary internet portal, the cancellation conditions stated there shall apply.

5.4 In case of non-arrival of the stay without notice of cancellation on the part of the guest as well as in case of early departure, the accommodation price for the entire stay is due.

5.5 The guest is recommended to take out a travel cancellation insurance.

6 Termination by the Löwenbaude team

6.1 The Löwenbaude team may terminate the contractual relationship before or after the start of the stay without notice if the guest violates these General Terms and Conditions, the General House Rules or, despite prior warning, fails to make the agreed payments on time or otherwise behaves in a manner contrary to the contract to such an extent that the Löwenbaude team cannot reasonably be expected to continue the contractual relationship.

6.2 In a case pursuant to 6.1, the Löwenbaude team may demand compensation from the guest for expenses incurred up to the termination and for lost income.

6.3 The right to terminate the contract for good cause remains reserved. In this case, both contractual partners shall be released from their contractual obligations. However, they must reimburse the respective other contractual partner for services already rendered, such as down payments.

7 Cancellation of the contract due to extraordinary circumstances

7.1 The Accommodation Agreement may be terminated by either party if the performance of the Agreement is significantly impeded, endangered or impaired as a result of force majeure unforeseeable at the time of conclusion of the Agreement. The same shall apply to an accommodation ban imposed by law and limited in time.

7.2 In this case, both contractual partners shall be released from their contractual obligations. However, they must reimburse the other contracting party for services already rendered, e.g. down payments.

8 Duties of the guest

8.1 After arrival, the guest has to inform the Löwenbaude team immediately of any defects in the vacation apartment or missing inventory. Otherwise, the vacation apartment shall be deemed to have been handed over in perfect condition.

8.2 The guest undertakes to treat the vacation apartment including inventory with all due care. The guest is liable to pay compensation for damage to furnishings, vacation rooms or the building as well as the common facilities belonging to the vacation rooms or the building (inside and outside), if and insofar as it was culpably caused by him or his companions or visitors. This also applies to the loss of glasses/china or defects in electrical equipment.

8.3 The guest must immediately notify the Löwenbaude team of any damage incurred in the building, in the vacation apartment and on the common facilities (inside and outside). The guest is liable to pay compensation for any consequential damage caused by failure to notify the Löwenbaude team in due time.

8.4 The guest is obligated to immediately notify the Löwenbaude team by telephone or e-mail of any malfunctions of electrical devices, in the building, in the vacation apartment as well as on the (outdoor) facilities, regardless of the guest's own fault. In the event of any faults occurring in the equipment and facilities of the building, the vacation apartment as well as the outdoor facilities, the guest is obliged to remedy faults within the scope of his abilities or to keep foreseeable damage to a minimum.

8.5 The guest is recommended to take out a liability insurance.

9 Liability of the Löwenbaude Team

9.1 The Löwenbaude team is liable for the correctness of the description of the vacation apartment and is obligated to duly provide the contractually agreed services and to maintain them for the entire duration of the guest's stay.

9.2 The liability of the Löwenbaude team for property damage in tort is excluded, unless it is based on an intentional or grossly negligent breach of duty. The Löwenbaude team is not liable in cases of force majeure (e.g. fire, flood, etc.).

9.3 The use of the vacation apartment as well as the common facilities and installations (inside and outside) is at your own risk; no liability is assumed by the Löwenbaude team.

10 House rules

10.1 A copy of the house rules is available in each vacation apartment or on the website www.loewenbaude.de/hausordnung). The house rules are part of the contract.

10.2 Mutual consideration is the key to a relaxing stay. Compliance with the house rules by all guests, their companions or visitors is assumed for the fulfillment of the contract.

11 Keeping of pets

11.1 Pets, in particular dogs, cats and the like, may only be brought into the vacation apartment with the individually granted permission of the Löwenbaude team. Furthermore, it is a prerequisite that the animals are disease-free, do not pose a danger to other guests and that the maximum number of three animals is not exceeded. The permission is valid only for the individual case. It can be revoked if unpleasantness occurs.

11.2 The placing of pets on beds and upholstered furniture or other furnishings is to be avoided in order to protect them. In case of soiling or odors in the vacation apartment due to the keeping of pets, the guest will be charged double the final cleaning price.

11.3 Pets must not be left unattended in the vacation apartment. The guest is liable for all damages caused by keeping pets.

12 Spa fees

12.1 The Löwenbaude team will take care of the settlement of accruing spa fees with the responsible spa administration on behalf of its guests. In return, the guests agree to provide the Löwenbaude team with all necessary personal data, which is required for the proper declaration to the responsible spa administration and a correct calculation.

12.2 Unless otherwise agreed, the spa fees are to be paid directly to the Löwenbaude team in any case, as these are usually not included in a payment processing via booking portals.

13 Choice of law and place of jurisdiction

13.1 Any disputes arising from the contractual relationship shall be subject to German law. The local court in whose district the defendant has his general place of residence shall have jurisdiction. The district court of Braunschweig shall be responsible for the Löwenbaude team.

13.2 For guests whose general domicile or place of residence is unknown, who have their general domicile or place of business abroad, or who have moved their domicile or place of business there after booking, as well as for merchants, legal entities under public or private law, the Löwenbaude team's place of jurisdiction shall apply.

14 Data protection

14.1 Personal data of the Guest shall only be collected and processed within the framework of the statutory provisions of the Federal Data Protection Act. They will only be made accessible to third parties to the extent that this is necessary for the processing of the accommodation.

15 Severability clause

15.1 Should one or more provisions of the contract be or become void, ineffective or unenforceable, or should the basis of the contract or contractual provisions in fact not occur or cease to exist in the future, this shall not affect the validity of the remaining provisions of the contract. Instead of the void, ineffective or unenforceable provision, such a provision shall apply by which the intended economic purpose is achieved as closely as possible.

15.2 If one party to the contract cannot invoke a provision of the contract due to mandatory statutory provisions, this shall also apply to the other party.

16 Amendments and Effectiveness

16.1 Significant ancillary agreements, amendments or supplements to the agreements made or to an accommodation contract must be made in writing.

16.2 These General Terms and Conditions shall enter into force on 01 November 2021 and shall be bindingly accepted by the Guest upon booking a vacation apartment.
